TINJAUAN YURIDIS PENGUASAAN TANAH NEGARA BEKAS HAK BARAT DI KOTA SURABAYA STUDI KASUS GELORA PANCASILA NO. 6 SURABAYA

Berlakunya Undang-Undang Pokok Agraria Nomor 5 Tahun 1960, maka tanah-tanah Negara bekas hak barat dikonversi menjadi hak atas tanah berdasarkan pasal 16 UUPA. Penguasaan tanah Negara bekas hak barat oleh Pemerintah Kota Surabaya salah satunya adalah Eigendom Verponding Nomor 12324 atas nama De Stads Gemeente Soerabaja terletak di Jalan Indragiri No. 6 dikenal sebagai Gelora Pancasila yang terkena ketentuan Keputusan Presiden Nomor 32 Tahun 1979 tentang Pokok-Pokok Kebijaksanan Dalam Rangka Pemberian Hak Baru Atas Tanah Asal Konversi Hak-Hak Barat. Penerbitan Sertipikat Hak Pakai Nomor 39/Kelurahan Darmo atas nama Pemerintah Kotamadya Surabaya di jalan Indragiri No. 6 tersebut menjadi obyek sengketa di Pengadilan Tata Usaha Negara Surabaya oleh PT Setia Kawan Abadi karena diatas tanah Eigendom Verponding tersebut berdiri bangunan Gelora Pancasila milik PT Setia Kawan Abadi. Tujuan dari penelitian ini adalah mengetahui proses penguasaan tanah Negara bekas hak barat oleh Pemerintah Kota Surabaya serta hambatan oleh PT Setia Kawan Abadi dalam memproses pendaftaran tanah. Penelitian ini adalah penelitian normatif dengan menggunakan pendekatan statute approach dan analytical approach. Bahan hukum yang dikaji meliputi bahan hukum primer dan sekunder yang dianalisis secara prekriptif. Hasil Penelitian bahwa Tanah Negara bekas hak barat Eigendom Verponding Nomor 12324 atas nama De Stads Gemeente Soerabaja adalah asset Pemerintah Kota Surabaya berdasarkan Undang-Undang Nomor 1 Tahun 2004 tentang Perbendaharaan Negara. Sedangkan bangunan Gelora Pancasila adalah milik PT Setia Kawan Abadi. Penyelesaiannya dilakukan dengan cara PT Setia Kawan Abadi Membeli tanah tersebut dari Pemerintah Kota Surabaya dengan gugatan perdata atau Pemerintah Kota Surabaya melakukan kerja sama sama dengan PT Setia Kawan Abadi.

The issuance of a Use Rights Certificates Number 39/Kelurahan Darmo on behalf of The Goverment of Indragiri No. 6 Surabayain the way this will be the object of dispute in state administrative courts Surabaya by Setia Kawan Abadi Company the ground because the Eigendom Verponding buildings Gelora Pancasila owned by Setia Kawan Abadi Company. The Aim of this research is to find the right of control of the former state in The Western City of Surabaya State of obstacle and the land registration process. This research is research normative by adopting both statute approach and analytical approach. Material of the study law a covering material primary and secondary law that have been analyzed in prekriptif. The result is that the ground state of Eigendom Verponding a number of Western 12324 De Stads Gemeente Soerabaja the assets city administration, Surabaya is in accordance with the Act No 1/2004 about The Country. The Gelora Pancasila building are owned by friends forever. The case was Setia Kawan Abadi Company of the city administration bought the land lawsuit Surabaya to Surabaya or a city administration cooperating with Setia Kawan Abadi Company and a mortal.
