IMPLEMENTASI HAK PEKERJA TERKAIT HAK WAKTU KERJA PEKERJA KAFE DI KABUPATEN BANGKALAN
Abstract
The regulation of working hours is a crucial aspect of labor rights, as outlined in Article 77(1) of the
Indonesian Labor Law. In Bangkalan Regency, 72% of coffee shop workers at establishments such as
Stroom Coffee and Dine, Basecamp Café, and Kedai Pustaka work beyond the legal 40-hour weekly limit.
This study aims to analyze the reasons why coffee shop workers must receive proper rights concerning
working hours, in accordance with current labor regulations, and to evaluate the implementation of these
rights in Bangkalan Regency. Using empirical legal research, the study collected data through observations,
interviews, and documentation with workers and managers of local coffee shops. The results indicate that
many coffee shop workers suffer from negative effects due to excessive working hours, which exceed the
legal limit. Despite the flexible nature of coffee shop jobs, where working hours adjust to customer demand,
the implementation of labor regulations regarding working hours remains inadequate. Many coffee shops
in Bangkalan fail to comply with Article 77(2) of the Labor Law and its associated regulations, resulting in
overworked employees without sufficient rest or compensation.
