Implementation of Diversion for Juvenile Crimes at the Police Resort of Jombang Regency

Abstract

The increase in juvenile delinquency cases in Indonesia has become a major concern in the juvenile justice system, which emphasizes the protection and rehabilitation of children. One of the mechanisms regulated in Law Number 11 of 2012 on the Juvenile Justice System (UU SPPA) is diversion, which refers to the transfer of a child’s case from the formal criminal justice process to an out-of-court resolution. This study aims to analyze the implementation of diversion at the Jombang Police Resort, particularly in cases of juvenile gang assault. This research uses a juridical-empirical approach, collecting primary data through interviews and direct observation, as well as secondary data from relevant documents. The results show that the implementation of diversion at the JombangPolice Resort achieved a success rate of 90.9% between 2021 and 2023. However, challenges remain regarding public awareness and limited resources. The success is driven by clear policies, cooperation among stakeholders, and the application of restorative justice. The study recommends improving resource capacity, increasing public education on diversion mechanisms, and strengthening collaboration among stakeholders to enhance the effectiveness of diversion in resolving juvenile cases.
