Analysis of the Legal Considerations of State Administrative Court Judges in Deciding Employment Disputes in Decision Number 164/G/2020/PTUN.JKT
Abstract
This research discusses the analysis of the legal considerations of State Administrative Court (PTUN) judges in deciding employment disputes in Decision Number 164/G/2020/PTUN.JKT. The main focus of this research is how judges apply the principles of state administrative law, especially the General Principles of Good Governance (AAUPB) and the principle of legality as stipulated in Article 17 of Law Number 30 of 2014 concerning Government Administration, in assessing the validity of administrative decisions imposed on Civil Servants (PNS). The research method used is normative juridical with a case approach. The results showed that the Jakarta Administrative Court judge explicitly assessed that the decision of the Ministry of Religious Affairs official who imposed disciplinary sanctions on the plaintiff did not meet the elements of legality and procedural justice, because it was not based on adequate evidence and did not provide a proper defense opportunity. By overturning the sanction decision, the PTUN decision emphasized the importance of prohibiting abuse of authority by state administrative officials and providing effective legal protection for civil servants from arbitrary actions. This research contributes to the strengthening of legal control mechanisms and the protection of the rights of state civil apparatus in Indonesia's state administrative justice system.
