PENERAPAN PASAL 109 AYAT (2) KUHAP MENGENAI KEWENANGAN PENYIDIK DALAM PENGHENTIAN PENYIDIKAN

Abstract

Penghentian Penyidikan merupakan salah satu kewenangan penyidik dalam menghentikan suatu penyidikan perkara tindak pidana yang terjadi. Penerapan kewenangan tersebut kadangkala menimbulkan permasalahan. Hal tersebut terjadi dikarenakan adanya penyimpangan yang dilakukan oleh penyidik dalam proses tersebut. Mengenai penghentian penyidikan yang dilakukan oleh penyidik Polda Jatim atas perkara tindak pidana Pemalsuan Akta atas tanah milik Puskopkar Jatim. Maka, tujuan penelitian ini adalah untuk mengetahui penerapan Pasal 109 ayat (2) KUHAP mengenai kewenangan Penyidik dalam penghentian Penyidikan dan untuk memastikan Kewenangan Penyidik berupa Surat Perintah Penghentian Penyidikan sudah tepat dalam kasus tindak pidana pemalsuan akta atas tanah milik Puskopkar Jatim. Jenis penelitian ini adalah yuridis sosiologis. Penelitian ini akan mengkaji permasalahan dari peraturan perundang-undangan yang berlaku. Teknik pengumpulan data yang digunakan adalah wawancara dan dokumentasi. Teknik analisis data dalam penelitian ini menggunakan metode deskriptif kualitatif. Hasil penelitian menunjukkan bahwa penerapan penghentian penyidikan yang dilakukan oleh penyidik Polda Jatim atas perkara Pemalsuan Akta tidak sesuai dengan peraturan perundang-undangan. Penerapan penghentian penyidikan perkara Pemalsuan Akta tidak memenuhi prosedur yang telah diatur dalam Peraturan Kapolri nomor 12 tahun 2009 tentang pengawasan dan pengendalian penanganan perkara pidana. Penyidik Polda Jatim tidak melaksanakan 2 (dua) kali tahapan gelar perkara luar biasa. Penghentian Penyidikan yang dikeluarkan oleh penyidik sudah tepat karena perkara ini bukan merupakan tindak pidana. Hal tersebut disebabkan karena tidak terpenuhinya unsur-unsur dalam pasal yang dikenakan, dikarenakan obyek yang disengketakan masih belum jelas kepemilikannya dengan tidak adanya sertifikat hak yang dimiliki oleh pelapor maupun terlapor. Peristiwa tersebut merupakan Peristiwa Perdata mengenai Sengketa Hak Kepemilikan Tanah.

Abstract

The termination of Investigation is one of the investigator authorities to stop an investigation in the criminal case that occurred. The application of such authority sometimes has created problems. It happens because of the irregularities committed by the investigator in the process of mentioned. The termination of the investigation by the East Java Police investigators on criminal assault of Act forgery on land owned by Puskopkar Jatim. So, the purpose of this research was to determine th application of Article 109 paragraph (2) Criminal Procedure Code Regarding the uthority of the investigators in the termination of the investigation as well as to ensure the authority of the investigators in the form of cessation warrant investigation is right or not in the case of the crime of falsification of land certificates belongs Puskopkar Jatim. This research method is a juridical sociologic. This research will study the problems of the legislation. Data collection techniques using interviews and documentation. The data in this study using a qualitative descriptive method. The results showed that the application of the termination of the investigation by the East Java Police investigator on the case Act forgery does not comply with the legislation. The application of the termination of the investigation case of Act forgery does not fulfill the procedures stipulated in the Police Regulation No. 12 of 2009 on the supervision and control of the handling of criminal cases. East Java Police investigators did not implement two (2) times the outstanding phases of his case. The termination of the investigation issued by the investigators was appropriate because theis not a criminal offense. It was due to non fulfillment of the elements in article that used, because the object of the disputed remains unclear in the absence of a certificate of ownership rights owned by the complainant and reported. The events is private event about land ownership disputes.
