Pelaksanaan Hak Aksesibilitas Bagi Penyandang Cacat di Terminal Purabaya

Abstract

Penyediaan aksesibilitas bagi penyandang cacat merupakan perintah dalam Undang-Undang Nomor 4 Tahun 1997 tentang Penyandang Cacat, namun hingga saat ini penyandang cacat belum sepenuhnya mendapatkan hak aksesibilitas secara optimal. Penelitian ini dilakukan untuk mengkaji pelaksanaan hak aksesibilitas bagi penyandang cacat di Terminal Purabaya kerena Terminal Purabaya merupakan terminal tersibuk di Jawa Timur (dengan jumlah penumpang hingga 120.000 per hari) serta upaya yang akan dilakukan UPTD Terminal Purabaya untuk meningkatkan aksesiblitas dan pelayanan kepada penyandang cacat. Penelitian ini merupakan penelitian hukum empiris dengan model penelitian hukum yuridis sosiologis. Adapun teknik pengumpulan data yang digunakan yaitu observasi fasilitas di Terminal Purabaya dan wawancara kepada pihak UPTD Terminal Purabaya serta Sekretaris Perkumpulan Penyandang Cacat Mandiri di Kabupaten Sidoarjo. Teknik analisis yang digunakan dalam penelitian ini adalah teknik analisis kualitatif. Hasil penelitian menunjukkan bahwa hingga saat ini aksesibilitas di Terminal Purabaya belum terlaksana sepenuhnya berdasarkan amanat Keputusan Menteri Perhubungan Nomor 71 Tahun 1999 tentang Aksesibilitas Bagi Penyandang Cacat dan Orang Sakit Pada Sarana dan Prasarana Perhubungan. Masih banyak fasilitas yang belum memudahkan penyandang cacat. Adapun upaya yang akan dilakukan UPTD Terminal Purabaya di antara yaitu pembangunan toilet yang akan didesain ramah bagi penyandang cacat serta jalur evakuasi khusus penyandang cacat dari tempat kedatangan sampai keberangkatan.

Abstract
The provision of accessibility for persons with disabilities arestipulated in Law Number 4 Year 1997 concerning Persons with Disabilities, but so far the persons with disabilities have not fully got the rights in an optimal accessibility. This research was conducted to study the implementation of accessibility rights for persons with disabilities in Purabaya Bus Station since Purabaya is the busiest bus station in East Java (by number of passengers up to 120,000 per day) as well as the attempts will be carried out by UPTD Purabaya Station to improve the accessibility and services to persons with disabilities. This research is an empirical law with juridical sociological research model law. The data collection techniques used is observation of facility in Purabaya, interview to the UPTD Purabaya Station and the Secretary of the Association of Persons with Disabilities in Sidoarjo. The analysis technique used in this research is qualitative analysis techniques. The results showed that up to now the accessibility in Purabaya bus station has not been implemented completely according to the Minister of Transportation Decree Number 71 Year 1999 concerning Accessibility for Persons with Disabilities and the Sick On Transportation Infrastructure. Many facilities in Purabaya have not facilitated the persons with disabilities. As for the measures to be taken by UPTD Purabaya Station including the construction of the toilets for persons with disabilities as well as an evacuation route from arrivals to departures.
