ANALISIS YURIDIS PUTUSAN MAHKAMAH KONSTITUSI NOMOR 14/PUU-XI/2013 BERKAITAN DENGAN PEMILU SERENTAK DENGAN PENETAPAN PRESIDENTIAL THRESHOLD TERHADAP PEMILU PRESIDEN DAN WAKIL PRESIDEN

Pemilihan umum Presiden dan Wakil Presiden adalah pemilihan umum untuk memilih Presiden dan Wakil Presiden yang dilakukan setelah pemilihan DPR, DPD, DPRD semenjak dikeluarkanya Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 maka pemilihan umum dilakukan sekali dalam lima tahun hal itu menimbulkan persoalan berkaitan perlu tidaknya pemberlakuan presidential threshold.

Tujuan dalam penelitian ini adalah untuk mengetahui kesesuaian pemilu serentak dan  dengan keluarnya Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 tentang pemililhan umum serentak masih diperlukan Presidential threshold adapun metodologi yang digunakan adalah jenis penelitian normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konsep, dan pendekatan kasus dengan mengkaji putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013.

Hasil penelitian menunjukan  bahwa putusan Mahkamah Konstitusi 14/PUU-XI/2013 sudah sesuai dengan penafsiran gramatikal dan penafsiran tekstual pada pasal 6A dan 22E UUD NRI 1945 untuk memilih Presiden dan Wakil Presiden. Tidak dapat menetapkan presidential threshold karena pemilihan umum Presiden dan Wakil Presiden diselenggarakan di hari yang sama sehingga tidak dapat menetapan presidential threshold sebelum pemilihan umum dilaksanakan.

Abstract

 

The elections of President and Vice President are the elections to choose the President and Vice President who conducted after the election of representatives, DPD, since release rule of the Constitutional Court 14/PUU Number-XI2013, so the electtion are conducted once every five years it raises related to whether the enactment of presidential threshold.

The purpose of the research is to know how the suitability of simultaneous elections and to know whether the Constitutional Court's ruling to expel 14PUU-XI2013 Number of concurrent public election still required Presidential threshold, as for we used is a kind of normative research using an approach legislation, concept approach and approach the case by examining the ruling of the Constitutional Court Number 14PUU-XI2013.

The research results showed that the ruling of the Constitutional Court of 14PUU-XI2013 is in compliance with the grammatical interpretation of textual interpretation and in section 6A and 22E NRI 1945 constitution to elect a President and Vice President. Unable to set the presidential election because the threshold for the President and Vice President were held on the same day so it can't be decide the presidential election before the threshold is implemented.
