ANALISIS PUTUSAN DEWAN KEHORMATAN PENYELENGGARAAN PEMILU (DKPP) NO.74/ DKPP-PKE-II/2013 TENTANG DUGAAN ADANYA PELANGGARAN KODE ETIK PADA SENGKETA PEMILIHAN GUBERNUR DAN WAKIL GUBERNUR JATIM TAHUN 2013

Keputusan hukum DKPP yang meloloskan pasangan Khofifah-Herman untuk mengikuti pemilihan gubernur Jawa Timur tahun 2013 dipertanyakan. Pasalnya, DKPP tak memiliki kewenangan hukum untuk membatalkan keputusan yang telah dibuat oleh KPU Jawa Timur termasuk mengenai keikutsertaan Khofifah-Herman di pemilukada Jatim. Seharusnya DKPP hanya mempunyai fungsi dan  wewenang mengenai kode etik.

Penelitian  ini akan menjawab pertanyaan mengenai sesuai atau tidaknya putusan DKPP No.74/ DKPP-PKE-II/2013 Tentang  Dugaan Adanya Pelanggaran Kode Etik  Pada Sengketa Pemilihan Gubernur Dan wakil Gubernur Jatim Tahun 2013 dengan perundang-undangan. Penelitian ini menggunakan metode penelitian  normatif yang di mana akan dilakukan analis peraturan-peraturan yang terkait permasalahan tersebut.

Hasil dari penelitian ini adalah PTUN lebih mempunyai wewenang dalam memutuskan sengketa atau adanya gugatan yang dilayangkan ke pihak Tata Usaha Negara. Karena di dalam peraturan perundang-undangan, khususnya Undang-Undang No.5 Tahun 1986 Tentang PTUN telah memberi kepastian hukum bahwa gugatan yang dilayangkan kepada penyelenggara Negara akan diproses dan diputuskan dalam Peradilan Tata Usaha Negara karena sengketa tata usaha negara selalu akibat dari dikeluarkannya keputusan Tata Usaha Negara.

Putusan DKPP No.74/ DKPP-PKE-II/2013 Tentang Dugaan Adanya pelanggaran kode etik merupakan putusan yang tidak sesuai  fungsi dan wewenangnya yang merupakan lembaga negara yang memutuskan tentang fungsi kode etik terhadap stake holder pemilihan umum yang melanggar kode etik di lembaga penyelenggara pemilihan umum.Putusan tersebut tidak sesuai dengan peraturan perundang-undangan karena sesuai dengan pasal 11 ayat 3 dan 4 Undang-Undang No. 15 tahun 2011 tentang penyelenggaraan pemilihan umum DKPP selaku lembaga penyelenggara negara hanya bisa memutuskan suatu perkara yang bersangkutan dengan kode etik.

Abstract

                   The verdict of DKPP (Dewan Kehormatan Penyelenggaraan Pemilu), that legalizes the Governor and Vice-Governor Candidate, Khofifah-Herman, to join the regional election was left questioned. This doubt was established because DKPP doesn’t have any legal authority to abort the decision that has been made by the KPU (Komisi Pemilihan Umum), for the East-Java’s regional election. DKPP only has functions and authorities about ethical code.

                   This research gives the answer to the question whether the DKPP verdict number 74/DKPP-PKE-II/2013 relevant to the regulations concerning the violation of ethical code to the governor and vice-governor election in 2013. The research uses the normative juridical method to analyze the regulations related to the result’s problem.

                   The results of the analysis are PTUN (Pengadilan Tata Usaha Negara), has more authority to decide the problem of the accusations from the Tata Usaha Negara (Nation’s Administration). Because inside of the regulations, especially Law number 5, year 1986 concerning PTUN, clearly gives the law regulation for the accusations from the Nation’s administrators which will go to the process and will be decided in a Nation’s administrators’ justice, because the problems often be caused by the administrators' decision.

                   The verdict of DKPP Number 74/ DKPP-PKE-II/2013 concerning the probability of violation is the unsuitable decision for the functions and regulations to the National Organization. This decision is violating the ethical code to the stake holders of the public elections and also violating the elections executants. That decision is distantly irrelevant with the national regulations, because in one of the articles inside it, number 11 subcition 3 and 4 Law number 15 year 2011 concerning organized of general elections, DKPP as the only organizer that is able to decide or finish the problems about or related to the ethical codes.
