KONSTRUKSI MASYARAKAT TERHADAP MANTAN NARAPIDANA

Diskriminasi yang ditunjukkan oleh masyarakat terhadap mantan narapidana menjadi fenomena yang yang tak seharusnya terjadi di tengah masyarakat. Konstruksi negatif masyarakat terhadap mantan narapidana menjadi latar belakang utama fenomena ini muncul, dengan adanya fenomena tersebut menimbulkan masalah-masalah lain yang dapat merugikan kedua pihak. Penelitian ini menggunakan metode kualitatif dengan pendekatan fenomenologi Alfred Schutz, dengan menggunakan teori konstruksi sosial Berger dan Luckmann yang mengupas bagaimana proses konstruksi yang dibangun oleh masyarakat Desa Mendogo, Kecamatan Glagah, Kabupaten Lamongan, sehingga melahirkan diskriminasi terhadap mantan narapidana.

Hasil penelitian ini menunjukkan bahwa konstruksi masyarakat terhadap mantan narapidana dipengaruhi oleh beberapa faktor penyebab. Bentuk konstruksi masyarakat lebih dipengaruhi oleh proses eksternalisasi, internalisasi dan objektivasi yang dilakukan oleh masyarakat. Eksternalisasi lebih ditekankan bagaimana masyarakat mengadopsi sumber informasi yang diterima, objektivasi dimana masyarakat lebih memandang tindak kejahatan yang dilakukan mantan narapidana dan bagaimana lemahnya lembaga hukum dalam menjalankan fungsi hukum, internalisasi dalam proses ini masyarakat memberikan pertimbangan dengan tetap menghargai mantan narapidana.

Abstract

Discrimination that shown by the public against the ex-convict who became a phenomenon that should not be happening in the community. Negative construction given to the former inmates into the main background of this phenomenon emerged, with the phenomenon raises other problems that can harm both parties. This study used qualitative methods with Alfred Schutz phenomenological approach, by using the theory of social construction Berger and Luckmann that explore how the construction process to be built by the villagers Mendogo, Glagah district, Lamongan regency that causes discrimination against former prisoners. Results of this study demonstrated that the social construction given to the former inmate is influenced by several factors. Social construction of the society more influenced by the process of externalization, internalization and objectification will be undertaken by the community. Externalization were emphasized how people adopt accepted the resources are in, objectification  more people looked at the crime do the former inmates and how weak legal institutions in performing judicial functions, internalization in this process to give consideration to the community while respecting ex-convicts.
