Larangan Penjualan Rokok Pada Anak Di Kecamatan Tambaksari Kota Surabaya
Abstract
Usia mulai merokok semakin memprihatinkan sejak usia 5 tahun. Jumlah perokok anak makin tahun semakin meningkat, bahkan jumlah perokok anak meningkat 6 kali lipat. Salah satu faktor pendorong aktivitas merokok yang dilakukan oleh anak usianya di bawah 18 (delapan belas) adalah kemudahan dalam memperoleh rokok tersebut. Pemerintah mengeluarkan beberapa kebijakan dalam meningkatkan derajat kesehatan masyarakat terutama mengurangi dampak negatif rokok terhadap generasi muda. Penelitian ini untuk mengetahui penegakan hukum atas Peraturan Pemerintah Nomor 109 tahun 2012 tentang Pengamanan Bahan Yang Mengandung Zat Adiktif Berupa Produk Tembakau Bagi Kesehatan (selanjutnya ditulis: PP Pengamanan Produk Tembakau bagi Kesehatan) pasal 25 ayat (b) dan faktor-faktor yang mempengaruhi penegakan hukum atas aturan tersebut. Metode penelitian ini adalah penelitian yuridis sosiologis. Adapun teknik pengumpulan data yang digunakan yaitu teknik wawancara dan observasi. Teknik analisis data menggunakan analisis kualitatif. Berdasarkan hasil penelitian, Tidak ada penegakan hukum terhadap PP Pengamanan Produk Tembakau bagi Kesehatan pasal 25 ayat (b) atas larangan penjualan rokok pada anak di bawah usia 18 tahun di Kecamatan Tambaksari kota Surabaya. Ada beberapa faktor yang mempengaruhi penegakan hukum atas larangan penjualan rokok pada anak di bawah usia 18 tahun di Kecamatan Tambaksari yaitu faktor penegak hukum dan faktor masyarakat. Mayoritas warga yang tidak tahu mengenai aturan ini karena kurangnya sosialisasi dari aparat penegak hukum. Penegak hukum tidak pernah melakukan pengawasan dan tindakan apapun terhadap pelanggar.

Abstract
The age of started smoking even more concerning (since the age of 5 years). The number of child smokers are increasing every year, even it is estimated that the number of child smokers is going to increase six times. One of the factors which motivate the child under 18 years old is the ease of obtaining cigarettes. the government issued several policies to improve public health, particularly reducing the negative impact of smoking on children. This research was to determine the enforcement of the Government Regulation Nomor. 109/2012 about Security of Materials Containing Addictive Substances in Form of Tobacco Products For Health Article 25, paragraph (b) and the factors effecting the enforcement the rules. This research method is a juridical sociological research. The data collection techniques used are interview and observation. Data were analyzed using qualitative analysis. Based on the data results, there is no law enforcement of the PP for the Tobacco Products Security Health Article 25 paragraph b on prohibiting the cigarettes selling to the children in Tambaksari, Surabaya. There are several factors that affecting the enforcement the rules of on the salling of cigarettes to children under the age of 18 years in the Tambaksari,Surabaya : the law enforcement and communty factors. The majority of citizens who do not know about this rule because of the lack of socialization from law enforcement officers. There is no control and never do any action against offender.
