Pelaksanaan Jaminan Sosial Bagi Pekerja Rumah Tangga Pasca Berlakunya PermenakerPerlindungan PRT

Abstract

ABSTRAK
Tanggung jawab atas berbagai pekerjaan yang dibebankan kepada pekerja rumah tangga (selanjutnya
disebut PRT) menuntut jaminan bagi kehidupan sosial ekonomi PRT, salah satunya dengan cara
memberikan jaminan sosial. Pemerintah melindungi hak-hak PRT melalui Permenaker Nomor 2 Tahun
2015 tentang Perlindungan PRT (selanjutnya disebut Permenaker perlindungan PRT). Permenaker
perlindungan PRT tidak hanya menjadi aturan bagi PRT saja namun aturan main bagi pengguna jasa PRT
dan lembaga penyalur pekerja rumah tangga. Dalam permenaker tersebut pengguna jasa PRT wajib
mengikutsertakan jaminan sosial untuk PRTnya. Penelitian ini bertujuan untuk memberikan gambaran
pelaksanaan pemberian jaminan sosial bagi PRT yang tergabung dalam anggota LSM SAKPPD
Surabaya, dan kendala dalam pelaksanaan pemberian program jaminan sosial. Metode penelitian ini
adalah yuridis sosiologis. Teknik analisis data menggunakan kualitatif bertujuan untuk memberikan
gambaran berkaitan dengan permasalahan yang peneliti angkat. Teknik pengumpulan data melalui
wawancara dan dokumentasi dengan Dinas Tenaga Kerja, BPJS Kesehatan, LSM SAKPPD, PRT dan
pengguna jasa PRT. Berdasarkan hasil penelitian, bahwasanya jaminan sosial yang dimaksud dalam pasal
11 huruf (g) Permenaker perlindungan PRT tidak terlaksana dibuktikan dengan pengakuan PRT yang
tergabung dalam anggota LSM SAKPPD, hal tersebut dikarenakan ada beberapa kendala yakni faktor
hukum karena Permenaker perlindungan PRT belum mempunyai kekuatan hukum yang kuat, faktor
sarana dan prasarana yakni belum ada pendataan, pembinaan, upaya untuk pelaksanaan pemberian
jaminan sosial PRT, dan faktor masyarakat yang masih menganggap PRT bukan pekerja sehingga haknya
diabaikan, faktor hambatan tersebut mengakibatkan PRT masih menanggung sendiri biaya yang akan
dikeluarkan ketika mengalami resiko sakit.

ABSTRACT
The responsibility of all kinds of the work which is charged to domestic workers demands a social and
economic’s warranty for their social life, such as by providing social security. The government protects
the rights of domestic workers by Man Power Ministerial Regulation Number 2/2015. Man Power
Ministerial Regulation Number 2/2015 is not only a domestic workers rule, but also to be the rule of
employer and domestic workers supplier. In this regulation, the employer has to register the social
security for their domestic workers. Based on this problem, the purposes of this research are describing
the implementation of social security for domestic workers who are members of LSM SAKPPD Surabaya
and constraints on the implementation of the provision social security. The method used in this research is
a juridical sociology method. The data analyzis techniques used is qualitative which has purpose to
describe the problems associated with this research. The data are collected by interviews and
documentation with several informants from Department Man Power, Social Security Board , LSM
SAKPPD, domestic workers, and empeloyer. According to the result, the social security referred to in
Article 11 (g) Man Power Ministerial Regulation Number 2/2015 has not been implemented properly,
proved by the argument of domestic workers who are members of the LSM SAKPPD, because there are
several obstacles such as the factor of law because Man Power Ministerial Regulation Number 2/2015
does not have strong legal force public legal awareness’ factors, facilities and infrastructures there is no
data collection, socialization, implementation effort of Man Power Ministerial Regulation Number 2/2015
from Department Man Power, and ,factors of society that still considers that domestic workers are not
workers so that their rights are ignored, and. These factors make the domestic workers still pay the
medical cost by theirself.
