IMPLEMENTASI YURIDIS KEWAJIBAN PENGIKATAN KENDARAAN PADA KAPAL ANGKUTAN PENYEBERANGAN DI LINTAS PENYEBERANGAN KETAPANG-GILIMANUK

Abstract

Kegiatan penyeberangan di Pelabuhan Ketapang-Gilimanuk secara umum diatur di dalam Undang-Undang tentang Pelayaran, Peraturan Pemerintah tentang Angkutan di Perairan, dan Peraturan Pemerintah tentang Penyelenggaraan Angkutan Penyeberangan. Kegiatan penyeberangan harus memperhatikan aspek teknis tentang keselamatan penumpang, muatan, dan kapal. Salah satu aspek teknis keselamatan angkutan penyeberangan adalah pengikatan kendaraan. Kewajiban pengikatan kendaraan diatur pada Peraturan Menteri Perhubungan Nomor 30 Tahun 2016 dan Peraturan Menteri Perhubungan Nomor 115 Tahun 2016. Kewajiban pengikatan kendaraan pada kapal angkutan penyeberangan wajib dilakukan agar keselamatan penumpang terjamin, dan melindungi muatan kapal agar tidak rusak ketika terkena gelombang laut. Pengikatan kendaraan di lintas penyeberangan Ketapang-Gilimanuk belum terlaksana sesuai dengan Peraturan Menteri Perhubungan Nomor 30 Tahun 2016 dan Peraturan Menteri Perhubungan Nomor 115 Tahun 2016. Penelitian ini bertujuan untuk menganalisis dan mengidentifikasi implementasi yuridis pengikatan kendaraan, proses penjatuhan sanksi yang diberikan kepada operator kapal, dan hambatan dari implementasi yuridis pengikatan di lintas penyeberangan Ketapang-Gilimanuk. Penelitian ini merupakan penelitian yuridis sosiologis. Data dikumpulkan dengan observasi, wawancara, dan dokumentasi. Teknis analisis data kualitatif. Hasil penelitian menunjukkan bahwa implementasi yuridis pengikatan kendaraan di Ketapang-Gilimanuk mayoritas telah dilaksanakan, tetapi dalam pelaksanaannya terdapat kekurangan, seperti material pengikatan yang digunakan tidak sesuai dengan Peraturan Menteri Perhubungan tentang pengangkutan kendaraan, dan tidak semua kendaraan dilakukan pengikatan. Proses penjatuhan sanksi kepada operator kapal dikeluarkan oleh Direktorat Jenderal Perhubungan Darat melalui rekomendasi yang dihasilkan dari pengawasan lapangan oleh petugas lapangan OPP apakah pengikatan telah terlaksana sesuai dengan Peraturan Menteri Perhubungan. Hambatan dari implementasi yuridis pengikatan kendaraan yaitu kurangnya kesadaran hukum operator kapal untuk menyediakan tali pengikat yang sesuai dengan Peraturan Menteri Perhubungan, kurangnya kesadaran hukum petugas kapal untuk melakukan pengikatan kepada semua kendaraan, dan kurangnya petugas kapal yang tersedia untuk melakukan pengikatan kendaraan. Abstract The ferrying activity in Ketapang-Gilimanuk generally regulated in the Shipping Law, Government Regulations on Water Transportation, and Government Regulations on the Implementation of Crossings. The ferrying activity should pay attention on technical aspects of the safety of the passengers, cargo, and the ship. One of the technical aspects of the safety of ferry is the vehicle tying. The obligation of vehicle tying is regulated by The Minister of Transportation Law number 30 year 2016 and The Minister of Transportation Law number 115 year 2016. The obligation of vehicle tying in a ferry must be done in order to guarantee the safety of the passengers and to protect the cargo from being damaged when exposed to sea waves. Vehicle tying at the ferrying activity in Ketapang-Gilimanuk has not been done in accordance with The Minister of Transportation Law number 30 year 2016 and The Minister of Transportation Law number 115 year 2016. The aim of this study were to analyze and identify the juridical implementation of vehicle tying, process of giving fine to ship operators, and the obstacles of the juridical implementation of vehicle tying in Ketapang-Gilimanuk harbour. This study belongs to juridical-sociology study. The data were gained through observation, interview, and documentation. The data analysis qualitative. The result of the study showed that the juridical implementation of vehicle tying in Ketapang-Gilimanuk Harbour mostly was conducted well, however in the implementation there were some weaknesses, such as the material for vehicle tying was not appropriate as recommended by The Ministry of Transportation Law about vehicle transport, and the vehicle tying was not conducted to all vehicles. The process of giving the fine to ship operator was regulated by The General Director of Land Transportation through the recommendation was 2 gained through the field supervision by the OPP field operator whether the tying is conducted accordingly to The Ministry of Transportation Law. The obstacle of the juridical implementation of the vehicle tying was the lack of law awareness from of the ship operator to provide the appropriate ropes as ruled by The Ministry of Transportation Law, the lack of awareness of the ship operator to do the vehicle tying to all vehicles, and the lack of ship operator number available to do the vehicle tying.
