EFEKTIFITAS PENEGAKAN HUKUM TERHADAP MENARA TELEKOMUNIKASI (BASE TRANSCEIVER STATION) YANG TIDAK MEMILIKI IZIN MENDIRIKAN BANGUNAN MENARA DI KABUPATEN GRESIK

Jumlah pelanggaran Izin Mendirikan Menara Telekomunikasi (BTS) mengalami peningkatan, tercatat sebanyak 280 BTS di Kabupaten Gresik tidak memiliki Izin Mendirikan Bangunan Menara (IMB-M) secara lengkap. Pelaksanaan penegakan hukum administrasi oleh Satuan Kerja Perangkat Daerah Kabupaten Gresik hanya mencapai 11 BTS. Hal ini menunjukan bahwa terdapat gangguan terhadap efektifitas penegakan hukum administrasi BTS yang melanggar IMB-M, hal tersebut menunjukan adanya kendala dalam pelaksanaan penegakan hukumnya. Tujuan penelitian ini antara lain untuk mengetahui efektifitas penegakan hukum administrasi terhadap menara telekomunikasi (Base Transceiver Station) yang tidak memiliki izin mendirikan bangunan menara di Kabupaten Gresik, dan untuk mengetahui faktor yang mempengaruhi penegakan hukum administrasi terhadap menara telekomunikasi (Base Transceiver Station) yang tidak memiliki izin mendirikan bangunan menara di Kabupaten Gresik. Penelitian ini merupakan penelitian hukum empiris yang mengkaji hukum dari gejala sosial yang timbul di masyarakat. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan menggunakan metode pengumpulan data wawancara dan dokumentasi. Berdasarkan hasil penelitian yang diperoleh, dapat disimpulkan bahwa penegakan hukum administrasi yang dilakukan oleh SKPD terhadap BTS yang melanggar IMB-M di Kabupaten Gresik tidak efektif, hal ini terlihat pada pemberian sanksi yang belum dilaksanakan terhadap 280 BTS yang melanggar IMB-M. Efektifitas penegakan hukum tersebut tidak efektif karena dipengaruhi empat faktor yang menghambat pelaksanaanya yaitu faktor penegak hukum, faktor sarana, faktor budaya dan faktor masyarakat.

Abstract

The number of violations of Establish a Telecommunication Tower (BTS) has increased, as many as 280 base stations in Gresik Regency do not have complete building permit (IMB-M). The implementation of administrative law enforcement by the Regional Work Unit of Gresik Regency only reached 11 BTS. The difference in administrative law enforcement that has been implemented and has not been implemented against BTS that violates the license shows the existence of obstacles in the implementation of law enforcement. The purpose of this research is to find out the effectiveness of administrative law enforcement on base transceiver station that do not have tower building permits in Gresik Regency, to find out the factors that influence administrative law enforcement on base transceiver station that does not have tower building permits in Gresik Regency. This research is an empirical legal research that examines the laws of social symptoms that arise in the community. The approach used in this study is a qualitative approach using interview and documentation data collection methods. Based on the results of the research obtained, it can be concluded that administrative law enforcement carried out by SKPD on BTS that violates the IMB-M in Gresik Regency is less effective, this can be seen in the provision of sanctions that have not been implemented against 280 BTS that violate IMB-M. The effectiveness of law enforcement is lacking because it is influenced by four factors that hinder its implementation, namely Law Enforcement Factors, Means Factors, Cultural Factors and Community Factors.
