Pelindungan Hukum Bagi Pembeli Beriktikad Baik Dalam Jual Beli Hak Atas Tanah
(Studi Kasus Putusan Mahkamah Agung Nomor 2963K/Pdt/2016)
Abstract
Itikad baik menurut Subekti adalah tentang kejujuran, dimana orang yang beritikan baik memberikan kepercayaan kepada pihak lawan yang dianggap jujur dan tidak menyembunyikan sesuatu. Walaupun demikian tidak selalu suatu perjanjian dilakukan dengan dasar itikad baik seperti pada kasus putusan No 2963K/Pdt/2016 dimana sengketa tersebut mengenai perlindungan atas pihak yang mengikatkan diri terhadap perjanjian jual beli tanah dengan itikad baik. Kasus tersebut adalah tentang jual beli tanah terhadap tanah yang pada dasarnya bukan miliknya. Sengketa tersebut terdapat konflik doktrin nemo plus iurus transferre (ad alium) potests quam ipse babet (seseorang tidak dapat mengalihkan sesuatu melebihi dari apa yang dimiliki) dengan asas bona fides (itikad baik).

According to Subekti, good faith is about honesty, where people with good intentions give trust to the opponent who is considered honest and does not hide anything. However, not always an agreement is made on the basis of good faith, as in the case of decision No. 2963K / Pdt / 2016 where the dispute is about the protection of parties who bind themselves to the land sale and purchase agreement in good faith. This case concerns the sale and purchase of land against land which basically does not belong to him. This dispute there is a doctrinal conflict of nemo plus iurus transferre (ad alium) potests quam ipse babet (a person cannot divert something more than what he has) with the principle of bona fides (good faith).
