Abstract

The trial was hampered due to the situation in countries around the world that were shocked by the Corona Virus Disease or (COVID-19). So that the courts utilize technology to support the continuity of legal services by utilizing the e-court system which is based on Supreme Court Regulation Number 1 of 2019. However, this solution presents new problems for the community, namely most people feel confused and do not understand the existence of electronic trial methods. The purpose of this study was to find out the implementation of electronic (online) trials of criminal cases at the Bojonegoro District Court during the COVID19 pandemic and the inhibiting factors against the implementation of electronic (online) criminal trials during the COVID-19 pandemic at the Bojonegoro District Court. The results of the research show that there are still some problems in the implementation of the trial of criminal cases at the Bojonegoro District Court, both in terms of the arrangement and implementation of the trial. The legal umbrella for directing electronic preliminary examinations has also not taken root considering that Law Number 8 of 1981 concerning Criminal System Regulations has not fully regulated electronic preliminary examinations of criminal cases, related to the instability of the internet network, which is also a problem that hinders the process of information from suspects or defendants, and with one of the principles of criminal procedural law, namely the principle of the presence of the accused in front of the trial.
