       Pertimbangan hakim dalam putusan Nomor 18/G/2014/PTUN.BJM. mengenai ketentuan pemberlakuan stelsel positif pada perkara pembuktian kepemilikan hak atas tanah karena Bertentangan dengan ketentuan Pasal 32 ayat (2) Peraturan Pemerintah No. 24 Tahun 1997 kemudian Eksepsi Mengenai gugatan Penggugat daluarsa dan derogasi Pasal 32 ayat (2) PP 24 Tahun 1997 bagi para pihak dalam perkara sengketa sertipikat  ganda dalam hal ini harus atau wajib menjamin tegaknya Kepastian  Hukum  Bagi  Pemegang  Sertipikat  Hak  Atas  Tanah Selaku Pembeli Yang Beritikad Baik kemudian adanya Perlindungan Hukum Bagi Pemegang Sertifikat Hak Milik Tanah Yang Telah Berusia Diatas Lima Tahun.

Abstract

 Judges' considerations in decision Number 18 / G / 2014 / PTUN.BJM. Regarding the provisions on the application of positive systems in the case of proving land rights because it is contrary to the provisions of Article 32 paragraph (2) of Government Regulation No. 24 of 1997 then the Exception Regarding the Plaintiff's lawsuit which has expired and  suspended 32 paragraph (2) PP 24 of 1997 for the parties in the case of a certificate of double certificate in this case must or must be upheld by Legal Certainty for Holders of the Certificate of Land Rights as Buyers in good faith then continued protection above five years.
